Terms of Service

These Terms of Service ("Terms") govern your use of the Pacak mobile application (bundle id my.pacak.app) and this website (collectively, the "Service"), operated by Pacak ("we", "us", "our"). By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

Who can use Pacak

You must be at least 13 years old to create a Pacak account. By using the Service you confirm that you meet this requirement. If you are using Pacak on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

Your account

• You are responsible for keeping your sign-in credentials secure and for all activity that occurs under your account.
• Your username must not impersonate another person, contain offensive language, or violate any third-party rights.
• You may not create more than one account per person, or create an account on behalf of another person without their consent.
• If you suspect unauthorised access to your account, notify us immediately at hello@pacak.com.my.

What Pacak is — and is not

Pacak is a personal hiking logbook. It helps you record climbs, explore mountains, and share your trail story with other hikers in Malaysia. It is not a navigation tool, a safety service, or an emergency communication system. Do not rely on Pacak as your primary means of navigation or safety planning in the outdoors.

Safety disclaimer

Hiking in Malaysia involves real physical risk, including difficult terrain, extreme weather, and limited mobile coverage. Weather information shown in the app is sourced from third-party forecast providers and may be inaccurate. Mountain data (elevation, distance, permit requirements) is community-maintained and may contain errors. You are solely responsible for your own safety decisions in the outdoors. We accept no liability for injury, loss, or damage arising from reliance on information displayed in the Service.

Content you create

You retain ownership of the hike logs, notes, and photos you create in Pacak. By uploading content you grant us a non-exclusive, worldwide, royalty-free licence to store, display, and (where you have enabled sharing) show that content to other users of the Service. We do not claim ownership of your content.

You must not upload content that:

• is false, misleading, defamatory, obscene, or offensive;
• infringes the copyright, trademark, or privacy of another person;
• contains malware, spam, or unsolicited commercial content; or
• violates any applicable Malaysian law or regulation.

We may remove content that violates these rules and may suspend or terminate the account responsible.

Community sharing

When you opt in to share a photo or review on a mountain page, that content may be visible to all Pacak users. Shared reviews are displayed anonymously. Photos go through a moderation queue before they appear publicly. You can withdraw shared content at any time from inside the app.

Third-party integrations

Pacak integrates with third-party services including Strava and Google Sign-In. Your use of those services is governed by their own terms of service and privacy policies. We are not responsible for the practices of third-party services.

Pak Pacak — AI chatbot

Pacak includes an optional AI-powered assistant ("Pak Pacak") that answers questions about Malaysian mountains and your hiking data. Responses are generated automatically and may occasionally be inaccurate. Do not treat Pak Pacak responses as professional advice — always verify safety-critical information independently.

Intellectual property

All software, design, mountain data, achievement artwork, and other original material in the Service (excluding your content) is owned by or licensed to Pacak. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our written permission.

Termination

You may delete your account at any time from the Settings screen in the app or via our account deletion page. Deletion permanently removes your personal data and associated records from our active systems.

We may suspend or terminate your account if you breach these Terms, without prior notice in serious cases. If your account is terminated by us for a reason other than a breach of these Terms, we will give you reasonable notice where practicable.

Disclaimer of warranties

The Service is provided "as is" and "as available" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses.

Limitation of liability

To the maximum extent permitted by Malaysian law, Pacak will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or personal injury. Our total liability for any claim arising from these Terms or your use of the Service will not exceed the amount you paid us in the twelve months preceding the claim (which, as the Service is currently free, is zero).

Governing law

These Terms are governed by the laws of Malaysia. Any dispute arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts of Malaysia.

Changes to these Terms

We may update these Terms from time to time. We will update the "Last updated" date above and, for material changes, surface a notice inside the app before the change takes effect. Continued use of the Service after a change constitutes your acceptance of the revised Terms.
